Harare senior regional magistrate Hosea Mujaya yesterday slapped a rapist father with 26 years in jail saying that he is nothing short of a sadist.

The 53-year-old father, who had initially pleaded guilty to one count and not guilty to the other, was found guilty for raping and impregnating his 14-year-old daughter.

The father had the audacity to ask magistrate Mujaya for a non-custodial sentence as he had a big family to take care of to which Mujaya asked if raping his daughter was part of taking care of his family.

“You have committed a heinous offence, it is bad enough to rape once, but you raped her twice and she got pregnant, by pretending to be concerned about the pregnancy test, you showed how evil you are.

“In cross examination when you questioned her over who she had slept with first between you and Elliot, the court sensed jealousy, you were supposed to protect her but instead you exposed her to diseases and unwanted pregnancy, you should’ve felt ashamed to ask for a non-custodial sentence, having had four wives in your life, you didn’t rape because of you sexual appetite, but because you’re sadist,” said Mujaya.

Prosecuting Netsai Mushayabasa, proved that in June this year, the father got into the girl’s room and told her that according to their tradition, he was supposed to have sexual intercourse with his daughters as a blessing before she got married and had done the same with all her sisters who are now ‘happily married’ before raping her.

Later that month, he raped her again using the same method.

The matter came to light in September when the girl’s cousin discovered that she was pregnant and when she was asked, she advised her family that she was pregnant and a pregnancy test was done.

The girl told her stepmother that she had been raped by her father when she was at work and was treated at Parirenyatwa Hospital.

Of the 26 years, six were suspended on condition that he does not commit a sexual offence in the next five years, 20 effective.
