Another huge setback for Kamambo as High Court strikes case off the roll Felton Kamambo

FORMER ZIFA president, Felton Kamambo, who was seeking review of a magistrate’s decision to dismiss his application for discharge, had the matter struck off the roll.

Kamambo, who is facing bribery charges, had approached the High Court on appeal, for the stay of his criminal trial proceedings.

Magistrate Bianca Makwande, who is presiding over Kamambo’s bribery trial, had compelled the ex-football boss to be put to his defence, at the close of the State’s case.

In his urgent chamber application at the High Court, Kamambo claimed the magistrate was irrational such that her decision had amounted to a procedural irregularity.

“I will suffer irreparable damage if the order sought herein is not granted in the sense that my legal right, to an application of review, would have been taken away from me in a technical way by the magistrate,” argued Kamambo.

He went further to apply for stay of proceedings, which was also dismissed by Makwande, on the basis that the pending application for review at the High Court, which he was basing on, had no prospects of success.

Now, Justice Rodgers Manyangadze, has thrown out Kamambo’s application at the High Court for lack of merit.

“The application be and is hereby struck off the roll.

“There shall be no order as to costs,” reads the ruling.

Kamambo, who had his matter deferred last week after his lawyer indicated he was sick, is expected back in court on June 15, where he is set to be put to his defence.
