The High Court will tomorrow entertain a matter in which former Health and Child Care Deputy Minister Dr Edwin Muguti’s wife is seeking divorce on adultery grounds.

Tapiwa Muguti (nee Mukandi) instituted the divorce proceedings last year claiming that Dr Muguti had an adulterous affair.

She is claiming a share of their matrimonial property including houses in Vainona and Manresa, a grinding mill and vehicles.

In a supplementary affidavit she has however, submitted that the Manresa property is no longer subject to dispute after finding out that it wasn’t transferable, without Government approval.

According to the papers, the pair’s marriage has irretrievably broken down and there are no more prospects of them living together.

“The marriage has irretrievably broken down such that there is no prospect for the restoration of a normal marriage relationship,” reads the summons.

Dr Muguti has contested the summons saying his wife was demanding what was not due to her before blaming her for causing the rift after denying him conjugal rights.

He said the two entered into a de facto polygamous marriage by consent knowing four other children were already born from a previous marriage.

The former government official also claims he acquired the Vainona stand on his own using proceeds from a previous divorce settlement.

Dr Muguti said he acquired the Vainona stand on his own using proceeds of his previous divorce settlement.

“The tractor, the grinding mill, the sonic and KB 300 are sorely owned by the defendant, the Prado was written off after an accident.

“The Honda Fit and the Canter belong to the plaintiff and defendant has no interest in them.

“Parties do not co-own the livestock on the farm and in any event the numbers are inflated,” he said.
