The specialist gynaecologist who was being charged for aggravated indecent assault against human egg donor was yesterday acquitted after the presiding magistrate granted his application for discharge at the close of the State case.
Dr Tinovimba Mhlanga was being accused of sexual assault by his patient Tinotenda Zowa.
The state was alleging that the doctor had exceeded his boundaries as a medical practitioner when he examined Zowa on 14 March this year.
The State led by Cecilia Mashingaidze failed to prove that on 14 March the doctor had inserted his two right hand fingers several times into Zowa’s private parts without her consent.
It was further alleged that the he fondled her breasts and privates.
Harare Regional Magistrate Gloria Takundawa ruled that the evidence of the complainant was unrealistic and so manifestly unreliable that no reasonable court could safely act on it.
The court castigated the state for failing to call a doctor of or above the Mhlanga training and qualifications to explain the medical procedures attendant on human egg donations.
She ruled the evidence of a general practitioner Dr Edmore Gwiza as irrelevant as he was not qualified enough to speak to the issues the court had to decide on.
Zowa had conceded that she had confronted Mhlanga demanding US$1800 for her egg instead of the US$360 she had initially accepted.
The court also castigated Zowa who had posted her alleged ordeal on social media in a bid to soil Mhlanga’s name.
Mhlanga was represented by Harare lawyer Oliver Marwa.
