LAWYER Wonder Nyika was yesterday dragged to court to answer to fraud charges after he reportedly defrauded a client when he misrepresented that they were purchasing a residential stand on their behalf.
Nyika appeared together with his firm’s conveyancing clerk Elliot Mashanyare 38.
Nyika also appeared on behalf of his firm Nyika Legal Practitioners.
The court heard that in April 2018, Mashanyare got information that Sham Manungo was selling two residential stands in Crowhill in Harare and he then contacted Manungo on behalf of a client and was shown two stands numbers 9070 and 1248.
It is alleged that in October the same year, the complainant intended to purchase a residential stand and was referred to Mashanyare who is into Real Estate business through a friend.
Mashanyare, with the intention to defraud the complainant, misrepresented facts that there were vacant stands to offer in Crowhill and made arrangements for the complainant to view the stand and he showed her stand number 1248 belonging to Sham Manungo and lied that it was stand number 9070 measuring 1000 square meters valued at US$90 000.
On October 4 2018, the complainant acting on the misrepresentation paid a deposit of US$3000 towards the purchase of the stand and US$400 for the drafting of Agreement of Sale by Nyika and they fraudulently drafted an agreement of sale between the complainant and Crowhill Private Limited Farm being represented by Folremce Behane and appended a fake signature of Sham Manungo.
Mashanyare presented the fake agreement of sale to the complainant and misrepresented that it was assigned by the seller to facilitate signing of the agreement of sale as well as receiving the balance of US$6000.
The balance was paid between November 2018 to February 2019 and the complainant cleared the balance but later realized that she had been duped leading to the duo’s arrest.
