A City man has approached the courts claiming US$850 from Chiedza Cooperative for a stand refund after finding out that the stand lay on top of sewer line.
Gladys Mubaiwa approached Harare Civil Court claiming US$850 from Prosper Humbira and Bibiana Masara.
“I have discovered that the stand was on top of sewer network pipes so I told them to refund my money.
“I paid $1000 in forex and we negotiated for me to be refunded money I used to purchase the stand and they wanted to pay back in instalments.
“They gave me $150 in 2016 up to now they haven’t given me anything,” he said.
In response Prosper told the court that they gave Mubaiwa US$80 last month and he refused it citing that he wanted US$850.
“Last month our cooperative gave him US$80 and he refused to take the money and told us that he was going to sue us.
“We have tried to give him another stand but he refused saying he wanted a refund,” he said.
Masara told the court that they can’t pay him in forex opting to refund the money in local currency.
“Your worship, our cooperative can’t refund him in forex as he wants US$850 not in instalments.
“Chiedza Cooperative will refund him in local currency,” she said.
Presiding magistrate Tafadzwa Miti ordered Chiedza Cooperative to pay US$850 in local currency.
