RADIO and television personality, Tinopona Katsande, was on Monday granted a protection order against her baby daddy, Virimai Chigariro.
The two had agreed to have a reciprocal order granted but Harare Civil court magistrate Gamuchirai Siwardi said such an order was not covered for in the Domestic Violence Act.
“I cannot grant a reciprocal order because it is not covered for in the Domestic Violence Act. If the respondent wants his own protection order he should make his own application,†she said.
Virimai’s lawyer said their intention was to spare the court from dealing with the same parties and the same matter again.
“We did not want to open a flood gate of counter applications, if the order applies in a reciprocal manner that can be avoided. The parties are in consent that the order be granted, there is no dispute in the facts,†he said.
Tinopona’s lawyer Fiona Chandayengerwa confirmed that they had consented to a reciprocal order but implored the court to grant her client’s order.
Tinopona applied for a protection order alleging that Virimai physically abuses her and is also trying to tarnish her image.
She said their misunderstandings insured after she confronted Virimai over an affair he was having with a minor.
Siwardi granted the protection order in Tinopona’s favour.
