A top Harare lawyer yesterday appeared in court facing fraud charges involving over US$200 000.
Puwai Chiutsi was not asked to plead when he appeared before Harare provincial magistrate Vongai Muchuchuti-Guwuriro.
Allegations are that in September 2017, Chiutsi’s property called the remainder of subdivision of Lot 6 of Lots 190-5 Highlands Estate of Welmoed Harare was sold to Bariadie Investsments by the Sheriff of Zimbabwe acting in terms of a High Court order in a matter of Chiutsi and Elliot Rogers.
Chiutsi lost ownership of the property and tried several times to appeal against the High Court order but the appeals were dismissed up to the Supreme Court.
Knowing that his property had been sold to Bariadie, Chiutsi approached Tendai Mashamhanda and told him that his property was up for sale.
Chiutsi is said to have misrepresented to Mashamhanda and made an affidavit had no caveats or mortgages and sold it to him for US$230 000.
In application for bail, Chiutsi’s lawyer Admire Rubaya said his client deserved to be granted bail because he is of fixed aboard, he handed himself in to the police and pleaded not guilty to the charges hence is eager to stand trial and clear his name.
The matter was remanded to today.
